Trump Loses Appeal in E. Jean Carrol Case
Donald Trump’s year did not end the way he had hoped.
The ruling finally came down in Trump’s appeal of the $5 million verdict in the first defamation case brought by E. Jean Carroll.
Trump’s appeal of the verdict failed, but he may have more troubles ahead of him in this case.
Own Worst Enemy
Trump has lost two cases to E. Jean Carroll, having been sued again for running his mouth after the first case was lost.
Trump lost a second case to the tune of more than $80 million but he just won’t stop.
Just weeks away from taking office, Trump posted, “Should a woman go to jail for falsely accusing a man of rape? Retruth if you want justice for Trump.”
As far as the case is concerned, the appeal went before the 2nd Circuit Court of Appeals, which ruled, “Trump has not demonstrated that the district court erred in any of the challenged rulings” and “has not carried his burden to show that any claimed error or combination of claimed errors affected his substantial rights as required to warrant a new trial.”
Trump is expected to make another appeal to the Supreme Court, but don’t expect anything more to come of this once it goes before the court.
First, Justice Sotomayor oversees the 2nd Circuit, and she clearly will not have a friendly ear to approve the case going before the Supreme Court.
Secondly, if, somehow, the court accepts the case, there is no reason to believe the Supreme Court will reverse a decision in the lower court that was upheld at the appellate level if there was no apparent negligence in these decisions.
Now, I know the argument by Trump’s camp is that the suits were backed by Democrat operatives, but the court will not even consider that in its ruling, not to mention that GOP operatives do the same thing to take out Democrats.
My concern for Trump at this point is that his recent comments have opened him to yet another lawsuit, so he should write the check and just move on.
