AFL Sues Biden Administration for Deleted Records

It would appear that Joe Biden’s administration is not properly preserving administration records.

America First Legal (AFL), an organization headed by former Trump adviser Stephen Miller, just sued Biden over deleted records.

The kicker is that if Miller is successful, it could help Trump in his classified documents case.

Cannot Delete Those

In the filing, AFL accused the Department of Health and Human Services of violating the Federal Record Act.

The suit also names the National Archives and Records Administration (NARA), which is how this could help Trump.

According to America First Legal Vice President Dan Epstein, communications of lower-level officials were being deleted rather than preserved.

Epstein stated, "If the National Archives decides not to use the legal authorities it has regarding federal records, it certainly shouldn't make up legal authority that it doesn't have when it comes to presidential records.

"We expect our government to act in a transparent and accountable way and exercise equanimity when it decides to investigate certain allegations. We clearly haven't seen that in this case."

The CDC, which is under the HHS umbrella, confirmed that Miller is correct, stating, "Unless they were a capstone director/manager etc., it is my understanding all other employees’ emails are deleted 30 days after they leave the agency."

The law is pretty clear on this, stating that all government agencies must "make and preserve records containing adequate and proper documentation of the organization, functions, policies, decisions, procedures, and essential transactions of the agency and designed to furnish the information necessary to protect the legal and financial rights of the Government and of persons directly affected by the agency’s activities."

Epstein added, "You have maybe tens of thousands of government records every year that are destroyed without authority.

"But when it comes to Donald Trump, he gets prosecuted. Everyone else who doesn't have to stand for election gets a free pass."

If Miller wins this suit, you better believe that Trump’s attorneys are going to use this in some way to help Trump in that classified documents case.

For now, however, it will be a waiting game to see how this all pans out.
