Watchdog Groups Wants Cannon Removed from Trump Case
As we have been watching the Trump classified documents case, I have noted on several occasions that I expected Democrats to go after Trump-appointed Judge Aileen Cannon.
When Cannon dismissed the case against Trump on what I believe to be a faulty premise, they pounced.
Citizens for Responsibility and Ethics in Washington (CREW) is now after her, trying to remove her from the case.
Time to Go
When Cannon dismissed the charges against Trump, she did so citing a statement by Justice Clarence Thomas regarding the legality of the appointment of Special Counsel Jack Smith.
Now, I have discussed this issue extensively, so I won’t rehash it in full, but the AG’s authority to appoint a Special Counsel is clearly outlined in Title 28—Judicial Administration, Chapter VI, Part 600.
This particular issue was litigated decades ago and Title 28 has been the standard used since that time, including the appointment of John Durham by then-Attorney General William Barr.
Yet, for some reason, this was the reasoning behind Cannon's dismissal of the case. If necessary, it will be appealed and possibly go to the Supreme Court, where Smith will win.
Democrats were on the brink of filing a complaint against her before that, but the dismissal of the case was the last straw.
CREW argued, “Even before she dismissed this case on novel and insupportable grounds that ignored both statutory authority and Supreme Court precedent, Judge Cannon’s other extraordinary rulings and sluggish administration of the case had provoked well-founded concerns that she might be biased against the Government’s case and unable to manage that case impartially.”
Smith has actually already appealed the case, arguing that Cannon “deviated from binding Supreme Court precedent, misconstrued the statutes that authorized the Special Counsel’s appointment, and took inadequate account of the longstanding history of Attorney General appointments of special counsels.”
I am not trying to be the bearer of bad news, but his argument is very much on point and quite frankly, I would be surprised if Cannon is not eventually removed from the bench over this case.
I have called out more than a few judges appointed by Dems for their clear bias in the past, so not calling out Cannon here would make my a hypocrite. I may be a lot of things, but I will never lie to you guys in my reporting.
The truth here is that Cannot was wrong in this particular ruling... and decades of legal precedent proves it.
