Trump wins appeals court ruling on DEI orders
Donald Trump finally caught a break in the courts regarding his slew of executive orders.
On Friday, a federal appeals court reinstated some of the DEI program bans that Donald Trump’s executive order had put in place.
It was not a complete win for Trump, but it is still rather shocking considering how the courts have treated him this far.
Take the Win
As most of you already know, Trump has been having a very hard time with his executive orders in the courtroom.
He has been going up against mostly Democrat-appointed judges, who have blocked virtually every order he signed on his first day in office.
The DEI order was among them, but Trump did just get some relief from the appellate court.
What really shocked me about the ruling is that two of the three judges on the panel were appointed by Democrats.
Having said that, the victory did come with some restrictions, not to mention a lecture by the liberal judges, who were called out by the sole conservative judge on the panel.
Obama-appointed Judge Pamela Harris stated, “But my vote to grant the stay comes with a caveat.
“What the Orders say on their face and how they are enforced are two different things. Agency enforcement actions that go beyond the Orders’ narrow scope may well raise serious First Amendment and Due Process concerns.”
Judge Albert Diaz, who was also appointed by Obama, also gave a bit of a lecture, stating, “And despite the vitriol now being heaped on DEI, people of good faith who work to promote diversity, equity, and inclusion deserve praise, not opprobrium.”
The third judge on the panel, Judge Allison Jones Rushing, was appointed by Trump. She did not hold back on criticizing her fellow judges, stating that praising DEI “should play absolutely no part in deciding this case.
“We must not lose sight of the boundaries of our constitutional role and the imperative of judicial impartiality.
"Any individual judge’s view on whether certain Executive action is good policy is not only irrelevant to fulfilling our duty to adjudicate cases and controversies according to the law, it is an impermissible consideration.”
The stay will remain in place until the case is fully litigated, having originally been filed by the three national organizations, the Baltimore City Council, and the Baltimore Mayor.
We expect this order to be further challenged, but for now, Trump is going to take this win. Again, don't get too emotional over any win or loss, as all of these cases are expected to wind up before the Supreme Court before they are finally settled.
