Trump wins appeals court decision to fire Special Counsel boss

While Donald Trump has clearly had some issues in court, with virtually every order issued by Trump being challenged by Democrats or activists, he just scored a monumental win.

This brings us to the case of Hampton Dellinger, who was head of the U.S. Special Counsel’s office.

Trump had dismissed Dellinger, who then filed suit to be reinstated.

Big Win for Trump

Dellinger had won his case in the lower courts, but it was Trump who prevailed at the appellate level.

The order by the court stated, “The Clerk is directed to calendar this case for oral argument this term on the first appropriate date following the completion of briefing.”

Once again, the outcome seemed almost certain when it was revealed that two of the three judges on the panel were appointed by Republicans, with only Judge Patricia Millett being appointed by a Democrat (she is an Obama appointee).

President George H.W. Bush appointed Judge Karen Henderson, and President Donald Trump appointed Judge Justin Walker.

Dellinger could have filed an emergency appeal with the Supreme Court, but reports just broke that he is going to drop his suit.

Dellinger noted, “I think my odds of ultimately prevailing before the Supreme Court are long.”

Believe me, that is not an admission that he knows he is wrong but rather a dig against the Court that has six conservative justices, three of them appointed by Trump.

Dellinger added, “I think the circuit judges erred badly because their willingness to sign off on my ouster — even if presented as possibly temporary — immediately erases the independence Congress provided for my position, a vital protection that has been accepted as lawful for nearly fifty years.”

He later added, “I posed one question before saying yes: ‘you know I can’t and won’t ‘swallow my whistle’, right?

“My point was that I was going to follow and enforce the rules like an honest referee would even if some might perceive it as against the interests of certain individuals including the President.”

Trump has been trying to remove every Biden appointment possible, including whistleblower heads.

Short term, this is great for Trump, who can now appoint a replacement to fill that role, and you know it will be someone loyal to Trump.

In the long run, however, I am not sure this is the best for the country. The good thing about these posts as that they always run into another administration, but that is no longer likely going to be the case.

With this precedent, every incoming president will remove appointees and put their own people in place, which is likely to cut down on corruption and wrongdoing reports.

I guess time will tell if this was the right call for the country or not.
