Trump Team Looks to Have Case Dismissed Citing DOJ Past Behavior

Donald Trump has once again asked the court to dismiss one of his cases.

This time, his legal team filed a motion to have the classified documents case dismissed.

Trump’s attorneys cited past cases where the DOJ declined to file charges, with the implication that Trump is being purposely targeted because he is a presidential candidate.

How former presidents handle documents after leaving office has always been a point of discussion.

However, generally speaking, it never raises any alarms because they were the president and had the highest security clearances possible.

There is nothing nefarious in the former presidents holding these documents, as they usually refer to them in their post-office writings.

There is, of course, a process that is supposed to be followed, but I would love to see how many times that has actually been violated in the past.

Actually, Donald Trump’s legal team did some digging on this, hence the motion to have his case dismissed.

Trump’s attorneys argued, “American history is chock full of public examples involving alleged mishandling of classified information and documents, which did not result in the type of politically motivated charges that the Special Counsel’s Office has brought against President Trump and his codefendants.”

Recently, we had two cases where no charges were filed, that being Mike Pence and Joe Biden, both of whom were vice presidents when the documents were taken.

Trump’s attorneys went much deeper, though, citing incidents involving President Bill Clinton, Trump’s 2016 presidential opponent Hillary Clinton, former FBI Director James Comey, former CIA Directors David Petraeus and John Deutch, former National Security Adviser Sandy Berger, and former COVID-19 coordinator Deborah Birx.

His defense team added, “Dozens of public officials have faced allegations relating to the handling of classified information without being charged with the types of felonies alleged in the Superseding Indictment.

“In this case, the record adequately demonstrates impermissible prosecutorial motives, driven in an unprecedented fashion by a sitting president to serve his political objective of prosecuting his predecessor and opponent.”

I have never excused or made excuses for what Trump did, but I have also stated that I believed he was clearly being targeted here based on how the DOJ had handled these other cases.

Now that the matter is before the court, I guess we will finally get a legal ruling on whether the DOJ was, in fact, weaponized, or if Trump really did something nefarious here.
