Trump requests stay of New York 'unlawful sentencing'
The president-elect has moved to postpone the sentencing in the case of New York v. Trump, which is scheduled for January 10th, according to Fox Digital.
"Today, President Trump’s legal team moved to stop the unlawful sentencing in the Manhattan D.A.’s Witch Hunt," as Fox News reported.
"The Supreme Court’s historic decision on Immunity, the state constitution of New York, and other established legal precedent mandate that this meritless hoax be immediately dismissed," Trump spokesman and incoming White House communications director Steven Cheung told Fox Digital on Monday morning.
"The American People elected President Trump with an overwhelming mandate that demands an immediate end to the political weaponization of our justice system and all of the remaining Witch Hunts. We look forward to uniting our country in the new administration as President Trump makes America great again," Cheung continued.
Judge Response
In response to the filing, the Manhattan district attorney's office denied the motion to postpone sentencing on Monday afternoon.
"The Court should deny the defendant’s motion for an immediate stay and should proceed to sentencing as scheduled on January 10, 2025," the DA's office wrote in its response Monday.
Just days before Trump's inauguration as president on January 20, Judge Juan Merchan of New York scheduled the sentencing date for the case.
Last year, the president-elect asked the Supreme Court to dismiss the verdict in the case because of the president's immunity, but Merchan refused.
The sentencing hearing for Trump is scheduled for 9:30 a.m. on Friday, January 10. According to Merchan, the president-elect will not face jail time but rather a "unconditional discharge," meaning that he will not be punished in any way.
The Charges
Trump was convicted guilty of 34 charges of falsifying company records in the Manhattan lawsuit in May. Manhattan District Attorney Alvin Bragg's office established that Trump fabricated corporate records to hide a $130,000 payment to Stormy Daniels before the 2016 election to settle her 2006 affair allegations.

Trump posted to Truth Social on Sunday evening of the case.
Trump's sentencing has been delayed several times. After the Supreme Court declared in July that former presidents enjoy substantial protection from prosecution for official conduct in office, but not for unofficial acts, Trump's lawyers requested Merchan to reverse his guilty decision.
