Trump Requests Federal Court Take Over Hush Money Case

Donald Trump’s attorneys are making yet another move to try to delay the sentencing that is scheduled for September in the hush money case presented by Manhattan DA Alvin Bragg.

Trump was convicted on 34 felony counts in a case which I still believe Trump will either win on appeal or have any sentence imposed significantly reduced.

Hoping to avoid another bad news cycle in September, Trump is now hoping to have the case moved to federal court.

It Won’t Work

You guys have probably read about this in other conservative blogs where they will tell you how this is a brilliant legal maneuver on Trump’s behalf.

This is actually a move that Trump’s attorneys hope will delay sentencing while the process plays out.

Trump has zero chance of this case being moved to federal court, as he is once again citing presidential immunity.

I feel like I am beating a dead horse here, but when Trump paid the hush money, and when the ledger entries were made allegedly constituting business fraud, Donald Trump was not president, nor did it have anything to do with the official acts of a president.

To be clear, presidential immunity ONLY covers acts that would fall under a president’s purview. Donald Trump’s campaign and personal business have nothing to do with that, so presidential immunity DOES NOT apply here.

Even so, Trump’s attorneys, Todd Blanche and Emil Bove, argue that “Immediate access to such a forum is imperative and of the utmost urgency.

“Federal institutional interests associated with the Presidency, Congressional and FEC regulation of federal elections, and the integrity of the upcoming 2024 Presidential election are at stake.”

Trump also has a motion to have Judge Merchan removed due to a conflict of interest, but that motion actually has some teeth to it based on the business of Merchan’s daughter, although I doubt even that will work considering the nature of today’s courts.

I hate to be the bearer of bad news, but the argument that presidential immunity applies to the hush money case in any way, shape, or form is just flat-out wrong.
