Wow… Donald Trump finally got a fairly important win on the legal front.
Trump will have one less case to worry about after a PA judge granted him presidential immunity in a case that was filed against Trump by a state election worker.
The worker claimed that Trump’s statements led to the man being threatened, which led to him having a heart attack, reported Yahoo News.
Trump’s Fault
James Savage, a voting machine supervisor in Delaware County, Pennsylvania, had two lawsuits that were filed against Trump.
According to Savage, Trump, poll watchers, and former New York Mayor and Trump adviser Rudy Giuliani, among others, had “conspired to defame him and place him in a false light by publicly and falsely claiming that he tampered with the 2020 Presidential election results,” reported Breitbart.
Savage claims that even though Trump or the other parties never mentioned him by name, he believes that everyone else blamed him for the alleged election fraud.
Not to burst this man’s bubble, but I doubt anyone actually knew him by name in terms of voters casting votes, so this claim is pretty ridiculous.
After Judge Michael E. Erdos ruled in favor of Trump, the former president’s team celebrated the win.
They stated, “We are pleased with the Court’s decision to honor the long-standing principle of Presidential Immunity.
“Today, the Court made it clear that it is well within the President’s discretion to address the integrity of our election without fear of liability. We expect that the rest of Mr. Savage’s claims will similarly be disposed of as they are without merit.”
Judge Erdos stated that Trump’s comments were “undoubtedly a matter of great public concern” and that his remarks, on their face, “dealt with the cornerstone of our democracy elections.” His point was that they fell in line with his presidential duties, therefore, he was granted immunity for the comments.
Erdos wrote, “Speaking to the public on matters of public concern is part of a President’s official duties. Indeed, the President’s use of the ‘bully pulpit’ to address the Nation has historically been an important feature of the office.”
The judge did say that the plaintiff could pursue action against Trump in another court, but that “this case is not the proper place to do so.”
This is Trump’s first significant legal win in some time, so he can finally take this case off the stack and have one less thing to worry about heading into the primary season.
