Last week, the political world shook when more charges were dropped against Trump regarding the classified documents case.
The obstruction charges were related to the audio of Trump staffers saying that "the Boss," Donald Trump, wanted his staffers to delete the servers that held video footage that had been subpoenaed.
Trump is now accusing the special counsel of "prosecutorial fiction."
The Fine Line
First, let's look at what Trump said on this.
After the charges were announced, Trump posted on Truth Social, "Mar-a-Lago security tapes were not deleted.
"They were voluntarily handed over to the thugs, headed up by deranged Jack Smith. We did not even go to court to stop them from getting these tapes. I never told anybody to delete them. Prosecutorial fiction & misconduct! Election interference!
"Same as the Russia, Russia, Russia HOAX. They knowingly accuse you of a fake crime, a crime that they actually make up, you fight these false charges hard, and they try and get you on 'obstruction.' We are dealing with sick and evil people," reported Fox News.
Trump's attorney, Alina Habba, then appeared on Fox News to defend Trump…
The problem as I see it for Trump in the defense that he is presenting is that the special counsel did not accuse him of deleting the tapes.
The allegation was that Trump had allegedly ordered his staffers to delete the footage from the services, which would be, by definition, an attempt at obstruction.
Trump then blasted the DOJ for going after some of his staffers, telling Reuters, "They went after two fine employees yesterday, fine people. They're trying to intimidate people so that people go out and make up lies about me. Because I did nothing wrong."
I honestly have no idea how any of this will pan out because it largely depends on the judge and the makeup of the jury once it goes to trial.
What I do know is Trump’s legal problems are so high he cannot see over them at this point, and there is more to come. Don't forget, Georgia prosecutors are about to indict Trump for election interference, as that investigation just wrapped up and prosecutors are already chirping that an indictment is imminent.
This presents the problem of a man that could literally be in jail and still be the frontrunner candidate or possibly have already won the nomination for the GOP.
