Trump Legal Woes Disappearing After Election Win
When I was reporting on the election, one of the biggest questions we were asking was what would happen to Donald Trump’s legal problems.
Would prosecutors rush the cases or would they put them on ice? Or, even better, would they consider dropping the cases?
Special Counsel Jack Smith appears to have made his decision, and that is to drop the charges, at least for the time being.
Case Dismissed
Smith showed his hand about a few weeks ago when he canceled deadlines for the J6 case.
Now he just took it a step further, making the motion to have the charges dismissed without prejudice.
That is key, but I will get to that in just a second.
After Smith filed his motion, Judge Chutkan ruled, "The Government has moved to dismiss the Superseding Indictment without prejudice.
"Defendant does not oppose the Motion…and the court will grant it."
Without prejudice is important because this means that the charges can be brought again in the future if prosecutors would like.
My guess is that Smith will leave this for Democrats to chew on if they win the 2028 election.
Federal law prohibits a sitting president from facing federal charges, so Smith would have had to ice this case for at least four years anyway since none of them were close to going to court.
For Trump, it makes it all that more important to have a successful term to set the GOP up for a big win again in 2028.
If the GOP can do that, these cases are dead for sure.
However, if the GOP loses the 2028 election, and tensions are still high between the two parties, you better believe that Democrats will take one more stab at prosecuting Trump.
For that reason, we need to make sure they keep the majority after the run of special elections as well as the mid-term elections, which are typically horrific for the party in power.
