The Trump legal team is going for broke in the January 6 case.
Judge Chutkan and Judge Kelly have issued some of the longest sentences given to January 6 defendants who have been found guilty.
Chutkan is presiding over the January 6 case brought by Special Counsel Jack Smith, but Trump's legal team is trying to get her to recuse herself from the case, reported Breitbart.
Biased
I have zero doubt that Chutkan has already made up her mind regarding Trump's guilt.
I say this because she has gone on rants in several cases showing dismay that Trump was walking free while these defendants were all going to jail.
In one sentencing hearing, she stated, "I see the videotapes. I see the footage of the flags and the signs that people were carrying and the hats they were wearing and the garb.
"And the people who mobbed that Capitol were there in fealty, in loyalty, to one man — not to the Constitution, of which most of the people who come before me seem woefully ignorant; not to the ideals of this country; and not to the principles of democracy.
"It's a blind loyalty to one person who, by the way, remains free to this day."
Trump's legal team argued, "The public meaning of this statement is inescapable—President Trump is free, but should not be. As an apparent prejudgment of guilt, these comments are disqualifying standing alone."
I think it is highly unlikely that she will recuse herself because she has been chomping at the bit to get at Trump, but this could play into Trump's favor if he is found guilty.
All his attorneys would need to do is find one biased decision that cost them the case, and they should be able to get a new trial or win on appeal.
Chutkan will have to be utterly perfect in this case or she will wind up doing the exact opposite of what she has been dreaming about in these cases.
