Trump Files Motion to Dismiss New York Hush Money Case

Donald Trump is taking another swing for the fences in the New York hush-money case.

Once again, Trump’s attorneys have filed for the immediate dismissal of all charges.

According to the filing, the election results “supersede” the politically motivated case brought by Bragg.

Time to Dismiss

I have always stated that the Bragg case against Trump was ridiculous.

Even if we concede that Trump's actions were wrong, this is a “crime” that is usually settled with a fine, penalty, back taxes, and a public slap on the wrist.

Instead, Bragg turned it into three dozen felony charges by stacking ledger entries in the indictment.

Due to the deck being stacked against Trump from the outset, I thought he would lose the case in court, which he did, while having the sentence reduced or the verdict outright overturned on appeal.

The sentencing trial was due in December, but that has already been delayed by Judge Merchan.

Bragg has agreed to the delay, but he is still refusing to dismiss the case.

Trump attorney Todd Blanche, whom Trump has nominated to be the Deputy Attorney General, wrote to Judge Merchan requesting the case be dismissed.

He stated that "immediate dismissal of this case is mandated by the federal Constitution, the Presidential Transition Act of 1963, and the interests of justice, in order to facilitate the orderly transition of Executive power following President Trump’s overwhelming victory in the 2024 Presidential Election."

Rumors were already surfacing that Merchan was considering dismissing the charges, but this filing by Trump may delay that or change his mind, if Merchan was leaning toward dismissal.

I believe that Merchan is waiting on the decision by Special Counsel Jack Smtih to wind down the federal cases against Trump.

Smith cannot try Trump while in office, so, at best, he would have to have these cases sit on ice for four years until Trump’s term was completed.

If Smith does decide to drop the cases, I think Merchan will follow suit, but I also believe he will take his sweet time doing so just to make Trump sweat.
