Trump Attorneys Again Try to Have Willis Case Dismissed
You have to give Trump’s legal team an “A” for effort in trying to have the case brought by Fani Willis in Georgia derailed.
They have repeatedly made motions to have the case tossed, and they just did it again.
His attorneys now claim they have found the “death knell” for Willis in that she is prejudiced against Donald Trump.
Dismiss the Case
Trump attorney Steven Sadow has again filed a motion to dismiss the Georgie election interference case.
Sadow is leaning into several issues that have come up in an attempt to show that Fulton County DA Fani Willis is prejudiced against Donald Trump.
Sadow is also leaning into a comment made by former Georgia Supreme Court Justice Harold Nelson Hill in a case from four decades ago.
Hill had stated, “Before a trial, the court should be sensitive to the potential for prejudice to the defendant. I believe that a trial court should disqualify the state's attorney if his continued presence in the case would cause a reasonable potential for prejudice to the defendant.
"A reasonable potential for prejudice standard would rigorously protect defendants.
"It would not require a showing of actual, or likely, harm. Rather, the trial court would focus on the possibility of an unfair trial. Yet, this rule would place the burden on defendants of demonstrating some real, not imagined, chance of prejudice.'"
That was in regard to case in 1981, with Sadow arguing, “Here, even Hill's 'reasonable potential for prejudice' pretrial standard is easily met.
"With nationwide slanderous media coverage on every available network, appellants have shown that there is not only a 'real chance,' but a substantial probability, for unfair treatment during the trial process.”
Willis has not yet responded to the last motion, but I suspect it will not be successful.
Judge McAfee has been very fair throughout this trial, but he has not even come close to entertaining dismissing this case.
While there is no chance this case will go to trial before the election, if Trump does not win, he will be facing a very busy court schedule come fall.
