Trump Attorney John Eastman Disbarment Ruling by CA State Bar

There was some bad news this week for the Donald Trump camp.

Attorney John Eastman has been recommended for disbarment, and per the State Bar of California, he is no longer licensed to practice law.

Eastman was considered to be the architect behind Trump’s efforts to overturn the posted election results from the 2020 election.

Disbarred

The wake of destruction left behind Trump from his efforts to change the outcome of the 2020 election continues to grow.

The latest carnage is the legal career of John Eastman.

California State Bar Judge Yvette Roland oversaw the proceedings last week, recommending that Eastman be permanently disbarred.

In her 128-page ruling, Judge Roland, in part, stated, “Eastman conspired with President Trump to obstruct a lawful function of the government of the United States; specifically, by conspiring to disrupt the electoral count on January 6, 2021, in violation of [the federal conspiracy statute].”

This is not a good sign for Trump as his federal indictments move forward.

One defense that Trump could use in his January 6 case is that he was following the advice of counsel.

However, he would have to prove that he was following that advice in good faith.

Per Roland’s ruling that will be a harder argument to make because prosecutors will paint Eastman as an accomplice rather than Trump’s legal adviser.

Trump has always proclaimed that his attorneys told him that Pence had more authority than he actually did in regard to the certification of the election.

Trump sought private counsel after White House attorneys gave him information he did not necessarily want to hear.

While Trump supporters still do not agree, rest assured, the VP role in the election certification is more ceremonial than anything else, and Pence did not have the authority to do the things that Trump wanted him to do.

Attorneys that told him anything else were, at best, giving Trump a very loose interpretation of the Constitution in this matter.

To that point, Roland’s ruling further stated, “Based on the evidence, the Court finds that it is more likely than not that President Trump and Dr. Eastman dishonestly conspired to obstruct the Joint Session of Congress on January 6, 2021.”

Per Roland’s ruling, it will be a difficult narrative for Trump to push in court with his attorney having been disbarred and the judge that recommended the disbarment calling Eastman a co-conspirator rather than his legal counsel.
