Earlier this week, Donald Trump had a gag order slapped on him by Judge Chutkan.
This is the second gag order, with Judge Engoron hitting him with one in the fraud case.
On Tuesday, Trump filed an appeal to try to have the gag order lifted.
Let Me Speak
This gag order was inevitable with Donald Trump’s constant attacks levied on Truth Social.
Prosecutors have been successful in portraying these attacks as witness intimidation as well as Trump targeting these individuals for harassment by his supporters.
After the Engoron gag order was put in place, it was only a matter of time before Judge Chutkan sided with Special Counsel Jack Smith, who had already had a request on record for a gag order against Trump.
Trump’s legal team made the request on Tuesday, but they did not offer any supporting argument in the appeal.
However, it is a safe bet they will be arguing that Trump’s First Amendment rights are being violated by the gag order.
There is little chance this appeal will be successful based on how Trump’s previous appeals have gone, but his attorneys are likely planning on using all of this in his appeal if he loses this case, which is pretty much a certainty with Chutkan on the bench.
After the gag order was issued, Trump had a rally in Iowa to attend.
He told his supporters, “I’ll be the only politician in history that runs with a gag order where I’m not allowed to criticize people. Can you imagine this?
“We’ll appeal it and we’ll see. But it’s so unconstitutional. The good thing is we have so much support, it’s incredible.”
Trump attorney John Lauro added, “Mr. Trump is allowed to say things like this is a politically motivated prosecution. He is entitled to say things he is being treated unfairly. He is allowed to speak truth to oppression.”
It sounds great, but there is no way the judge is going to buy this argument and lift the gag order.
