Texas Supreme Court Pauses Lower Court Ruling
After Roe v. Wade was overturned, Texas was among the states that banned abortion.
Kate Cox, a 31-year-old mother of two, sued to have an abortion.
She won her case in the lower courts, but the Texas Supreme Court has ordered the decision to be paused.
No Exceptions
The Texas law has very strict exception clauses, but Cox apparently does not fall into that category.
Her unborn child has been given a fatal diagnosis with a very high mortality rate.
According to the report, the low survival rate for the baby’s condition paired with the danger of continuing the pregnancy and how it could impact Cox’s ability to have children in the future are why Cox wants to abort the child.
Cox initially won her case, which would have allowed her to have the abortion without current Texas law being enforced, but the Texas Supreme Court has just intervened, pausing the order.
Molly Duane, an attorney at the Center for Reproductive Rights, which is representing Cox, stated, “While we still hope that the Court ultimately rejects the state’s request and does so quickly, in this case we fear that justice delayed will be justice denied.”
According to Attorney General Ken Paxton, Cox does not meet the Texas exception criteria, stating, “Future criminal and civil proceedings cannot restore the life that is lost if Plaintiffs or their agents proceed to perform and procure an abortion in violation of Texas law.”
On Monday, Cox’s attorneys stated that she had left the state, stating, “Her health is on the line. She’s been in and out of the emergency room and she couldn’t wait any longer."
Cox’s attorneys did not reveal what state she went to for the abortion, nor did they say if Cox plans to return to Texas.
This is now a case that the entire country will be watching, as this has become one of the most heated election topics in recent years, widely believed to be one of the key issues that cost Republicans in the 2020 and 2022 elections.
In my opinion, this is the very reason that Democrats will never agree to any compromise with Republicans on a federal law, knowing full well it is one of the most powerful weapons they have in their arsenal right now.
