Texas AG Secures TRO Against Biden Administration

Well, now I have truly seen it all.

Texas Attorney General Ken Paxton has successfully obtained a temporary restraining order (TRO) against the Biden administration, which will prevent the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) from implementing a new rule.

Paxton continues to be a thorn in the side of Joe Biden.

Block Them

The ATF’s new rule is to try to block the private sale of weapons between law-abiding citizens.

In essence, Biden is trying to make it more expensive to conduct a sale such as this, eliminating what they say is a loophole in gun sales laws.

Paxton’s TRO will block the rule from taking place until at least June 2 so that a hearing can be held on the matter.

After the TRO was ordered, Paxton stated, “I am relieved that we were able to secure a restraining order that will prevent this illegal rule from taking effect.

“The Biden Administration cannot unilaterally overturn Americans’ constitutional rights and nullify the Second Amendment.”

Paxton’s argument was noted in the TRO order, explaining “understandably fear that these presumptions will trigger civil or criminal penalties for conduct deemed lawful just yesterday. Nevertheless, ATF avers that its ‘knowledge of existing case law’ and ‘subject-matter expertise’ will prevent misuse or abuse of the presumption.… in other words, ‘just trust us.’ … For the forgoing reasons, Plaintiffs are substantially likely to succeed on the merits.”

If the ATF rule is implemented, it would require that one of the individuals become a gun dealer or the deal would have to be brokered through a gun dealer, adding extra expenses to make the transfer legal.

This is a case that many Second Amendment supporters and gun organizations are watching like a hawk due to the financial ramifications against law-abiding citizens.

If Paxton is not successful at this level, it is a safe bet this case would wind up before the Supreme Court at some point.
