Supreme Court unlikely to get involved in the 2024 election: experts
Legal experts are predicting that the U.S. Supreme Court is unlikely to get involved in the 2024 presidential election.
This is according to several legal experts with whom Fox News has recently spoken.
If these experts are correct, then this completely undermines the narrative that has been pushed by Democrats - including by Trump's 2024 rival - Vice President Kamala Harris.
The false narrative, of course, is that the Supreme Court - with its conservative majority - is just waiting to do Trump's bidding should anything go wrong in the presidential election. The experts say that they have seen enough evidence to conclude that this simply will not happen.
Here is what they have to say:
Fox asked a number of election lawyers and legal experts what the chances are that the Supreme Court would get involved in an election dispute. The answer appears to be extremely low.
On expert - Jason Torchinsky, partner at Holtzman Vogel - said, "It's got to be super, super close. If you look at the history of post-election litigation, the only places where it has been successfully outcome-determinative really are in places where the vote is just super close."
That's not all, though. Torchinsky also said that, in order for the Supreme Court to get involved, there would have to be a "real issue" with the election.
"If there's a real issue, the Court will take it. If it's something that the Court doesn't think merits a higher-level view, then they'll summarily affirm," he said.
We'll have to see if anything rises to this high standard.
Looking forward
Based on what we have seen from Democrats and Republicans in recent months - the months leading up to the 2024 presidential election - both sides seem to be preparing for a serious post-election fight.
Several congressional Democrats, for example, have refused to say outright that they will certify the results of the election.
Also, the Washington Examiner reports:
The Harris campaign is playing defense by recruiting thousands of lawyers to advise and support their election strategies around Election Day. Democrats are bracing for former President Donald Trump’s campaign and allies to initiate legal battles over the 2024 election results if he loses, actions Republicans took following the 2020 election.
The Democrats, no doubt, are preparing to do the same should Harris lose.
Not just the Supreme Court but courts in general were reluctant to get involved in the 2020 election. If the legal experts are correct, then it is going to be a similar story in 2024, unless something really egregious happens.
