Supreme Court Likely to Uphold TN Ban

Transgender care for children has become a hot topic of debate over the last few years.

This is so because we have rules put in place in schools where teachers in blue states do not even have to tell parents if their children consider themselves to be trans.

Tennessee had put a ban in place on youth care, which is now being challenged by the parents of several transgender children and the Biden administration.

Likely to Uphold the Ban

One consistency with this court is that it is looking to dial down the overreach of the courts on issues that should be legislated.

Based on comments made by the conservative members of the court, that seems the likely route here.

The Biden administration was challenging the Tennessee rule, saying it violates the Constitution’s guarantee of equal protection.

Tennessee countered that the new law was not targeting transgender youth, but rather addressing medical care for all youth.

We all know the liberal justices on the court are going to side with the Biden administration, so the question then becomes if at least two of the conservative justices are willing to cross the aisle on this issue.

In cases such as this, I always focus on the comments made by Chief Justice Roberts, as the Trump-appointed justices tend to follow him, or I should say at least one of them tends to follow Roberts when he crosses the aisle.

Roberts was clear in rejecting this as an issue to be litigated, responding, “We’re not the best situated to address issues like that.”

If Roberts holds that line, I really don’t see anyone else crossing it.

I have been pretty clear where I stand on this issue, believing that this type of care should only be available for adults.

The fact we have 10-year-old children deciding they were born the wrong gender when their parents will not even let them decide what to have for dinner is a complete and utter joke to me.

Let the children grow up, and as adults, the choice is theirs.
