Smith Wastes No Time Responding to Supreme Court Filing

Part of the strategy for Donald Trump in his federal cases has been to delay the cases at every opportunity.

Trump has surely seen the polling on how a guilty verdict will impact his chances of winning the general election against Joe Biden.

That is exactly why when Special Counsel Jack Smith tried to take the case regarding Trump’s immunity right to the Supreme Court, Trump balked, wanting to exhaust all other legal means first.

Well, now it is before the Supreme Court, and Smith is wasting no time.

Don’t Need a Week

On Monday, Trump’s legal team filed an emergency motion to have the lower court ruling stayed regarding Trump’s immunity.

If that ruling is stayed, it means the cases against Trump come to a grinding halt while the issue is settled.

Tuesday morning, the Supreme Court gave Smith a full week to respond before taking the matter under consideration.

Well, Smith did not wait a week… within 24 hours, Smith had filed his arguments against the decision being stayed.

Smith argued, “Delay in the resolution of these charges threatens to frustrate the public interest in a speedy and fair verdict — a compelling interest in every criminal case and one that has unique national importance here, as it involves federal criminal charges against a former President for alleged criminal efforts to overturn the results of the Presidential election, including through the use of official power.”

To my earlier point that Smith wants to move this forward as quickly as possible, he argued, “An expedited schedule would permit the Court to issue its opinion and judgment resolving the threshold immunity issue as promptly as possible this Term, so that, if the Court rejects applicant’s immunity claim, a timely and fair trial can begin with minimal additional delay.

“The government proposes a schedule that would permit argument in March 2024, consistent with the Court’s expedition of other cases meriting such treatment.”

Now it is all in the court’s hands.

This is it for Trump… if the court rules in his favor regarding immunity, everything goes away.

If, however, the court rules that Trump’s actions were not in accordance with his presidential duties, these cases all go to trial.

If that happens and Trump is convicted in even a single case, his numbers tank, swinging completely in favor of Biden by at least six points, possibly more, depending upon the poll.
