RNC Appeals to Supreme Court in PA Ballot Case

The Republican National Committee (RNC) is hoping the Supreme Court will provide it with some relief regarding a challenge to provisional ballots being issued in Pennsylvania.

A recent ruling by the Pennsylvania state Supreme Court found that those who had a mail-in ballot rejected could cast a provisional ballot in person on election day.

The RNC wants that rule blocked and it is now appealing to the Supreme Court to make it happen.

No Vote

Typically speaking, the Supreme Court has tried to stay out of election cases.

To be honest, I was surprised (and wrong in my prediction) when the Supreme Court accepted a challenge by Virginia to have potential non-citizens removed from the voter rolls.

When I reported on this yesterday, I had stated this was the right decision, but I never expected the court to step in with its history of rulings in election cases.

This matter, however, is different.

The state Supreme Court ruled 4-3 in favor of a provisional ballot being issued if a voter has been alerted that their mail-in ballot was rejected for a technical reason.

The RNC is arguing, “When the legislature says that certain ballots can never be counted, a state court cannot blue-pencil that clear command into always. And here, the General Assembly could not have been clearer.”

The RNC has asked for a ruling by Friday so the issue is settled before election day.

One thing the courts have been adamant about over the last few years in these cases is that they want everyone to have the opportunity to vote that has the right to vote.

I just don’t see the Supreme Court disallowing legal American citizens to vote if they know their ballot has been corrupted before election day.

My guess is that the court will rule that if the voter is capable of getting to a polling station on election day and can prove they are that individual, there is no reason to block them from voting as long as the mail-in ballot has been removed from the system.

We will report on this as soon as we have an outcome, it being a battleground state this is currently a toss-up between Harris and Trump.
