Liberals Fighting Back Against GOP Effort to Remove New Justice from Redistricting Case

The Wisconsin Supreme Court is now leaning left after a liberal justice won a seat on the bench.

This is a major shift, and it has also put an activist on the bench.

To that point, the GOP is now working to have Justice Janet Protasiewicz recused from the case for redrawing district lines, an issue on which she campaigned.

Remove Her

The Democrats know that if they can get these lines drawn the way they want, they can effectively take over the state and boot quite a few Republicans from their House seats, which would be devastating in the effort to expand the House, putting the majority at risk.

The stance by conservatives in this case is that since Protasiewicz made comments during her campaign on this, specifically saying that the current maps are “rigged” for Republicans, she should be recused from the case.

The left is saying the stance taken by these complaints has no legal ground to stand on and would be “contrary to her duties as a justice on the Supreme Court,” reported AP News.

The filing to defend her, which comes from Law Forward, a Madison-based liberal law firm, the Stafford Rosenbaum law firm, Election Law Clinic at Harvard Law School, Campaign Legal Center, and the Arnold & Porter law firm, stated, “Unhappy with this electoral result, which they could not prevent through gerrymandering, (Republicans) now seek to nullify the results and pick their Justices,” reported CBS News.

Republicans are countering that she has prejudged the case, therefore, she needs to be removed.

The ramifications of Protasiewicz were felt immediately, as the court administrator appointed by the court prior was terminated, a move that brought major scrutiny because it was unprecedented.

When conservatives had taken control of the court, they let the existing administrator complete the term.

They also stripped some duties away from the state Chief Justice, which drew even more red flags for conservatives.

If the GOP is not successful in this case, it would then have to rely on Protasiewicz to recuse herself from the case, but that will never happen.

Trust me, these cases are going to send a shockwave through the GOP, with yet another election failure hanging over the head of current GOP leadership.
