PA Supreme Court Orders PA Election Board to Stop Counting Illegal Ballots

The Senate race in Pennsylvania was called for Republicans.

However, the margin was less than 0.5%, which triggered an automatic recount.

During the recount, Democrats were counting ballots having been deemed illegal, but the PA Supreme Court has stepped in.

Stop Counting

PA election rules state that ballots that are not properly dated or signed are not considered legal ballots, but that was not stopping PA Democrats from counting them in the election.

Democrats were openly brazen about defying the law, literally bragging about the fact they were counting illegal ballots.

The initial order for this had already come down from the Supreme Court, but Democrats now take rulings from the Supreme Court with a grain of salt.

The GOP filed about a dozen suits to block Dems, and one of them just went before the PA Supreme Court, handing the GOP a huge win.

In part, the ruling states, “The Court hereby ASSUMES its King’s Bench authority over the instant Application, see 42 Pa.C.S. § 502, only to DIRECT that all Respondents, including the Boards of Elections in Bucks County, Montgomery County, and Philadelphia County, SHALL COMPLY with the prior rulings of this Court in which we have clarified that mail-in and absentee ballots that fail to comply with the requirements of the Pennsylvania Election Code, see 25 P.S. §§ 3146.6(a), 3150.16(a), SHALL NOT BE COUNTED for purposes of the election held on November 5, 2024.”

Bucks County commissioners Diane Ellis-Marseglia and chair Robert Harvie Jr. made the decision independently to count hundreds of ballots that had been set aside because they were missing a date or misdated.

The appeal of the case by the GOP stated, “The Board did so even though its legal advisers recommended rejecting the ballots ‘based on the current state of the law.’”

This just reinforces a point I have been making for months, which is I don’t know why we even have election rules if the people in charge of enforcing those laws are not following them.

Thankfully, in this case, the court ruled in our favor, but we have seen far too many courts disregard state laws to allow votes such as these to be counted.

That is about as brazen as it gets… and now you know why so many people on the right no longer trust our elections as being free and fair.
