No Charges to be Filed ATF Shooting of Little Rock Airport Director

A controversial shooting that took place in March has finally been resolved.

Arkansas prosecutors are declining to press charges in the ATF shooting of the Bill and Hillary Clinton National Airport Executive Director Bryan Malinowski.

Malinowski was shot and killed by agents during the serving of a warrant on March 19.

According to ATF agents, while serving a warrant at Malinowski’s home, someone inside the home opened fire.

Agents returned fire, striking Malinowski, who was then taken to a hospital for treatment.

Malinowski died nearly two months after the shooting, bringing about a review of the case by the Arkansas State Police.

After the fact, it was revealed that Malinowski had purchased more than 150 guns over a roughly three-year span, catching the attention of the ATF.

The ATF stated that it approached the house with running sirens as well as agents identifying themselves before entering the home.

They also stated they announced their presence once inside the home while wearing clothing that clearly showed they were ATF agents, yet Malinowski still opened fire on them.

Pulaski County Prosecutor Will Jones concluded, "Given the totality of the circumstances, Agent 2 had a reasonable belief that deadly force was necessary to defend himself and Agent 1.

"Therefore, the use of deadly force by Agent 2 was in accordance with Arkansas law and was justified."

Malinowski's family pushed back on the report, stating that Malinowski was an avid gun collector and was not aware that he had been under investigation for having sold some of his guns at local gun shows.

Bud Cummins, the family's attorney, stated, "How long is it reasonable to wait for someone to answer their front door at 6:00 am in response to unexplained loud pounding in a 3000 square foot fully insulated home? Let's pray the answer isn't 28 seconds. The Fourth Amendment means more than that to every single one of us.”

Republicans have also been digging into the shooting, so I would suspect, as Cummins stated, this is far from over.
