ND Court Blocks ACA Coverage for Obama’s Dreamers
The Dreamers are a hot topic of discussion right now on more than one front.
Trump recently stunned his supporters by saying he wants to work with Democrats to work out amnesty for DACA recipients, known as Dreamers.
Additionally, a big ruling just came down in North Dakota revolving insurance coverage for Dreamers that is going to shake the tree quite a bit.
No Coverage
At question is whether Dreamers qualify for health coverage under the Affordable Care Act (ACA). Otherwise known as Obamacare.
The ruling came down on Monday via U.S. District Judge Daniel M. Traynor, a Trump-appointed judge.
The Biden administration had created a new rule that would allow some Dreamers to have coverage, but the ruling by Traynor has granted a stay regarding the rule for Kansas and 18 other states that had joined the suit.
The ruling will also place an injunction against the Biden administration from forcing these states to enforce the rule while this issue continues to be litigated.
The new rule was introduced by the administration in May, allowing active DACA recipients to qualify for basic coverage under the ACA.
Traynor stated, “The authority granted to CMS by the ACA is to ascertain whether an individual meets the requirements for lawful status. It by no means allows the agency to circumvent congressional authority and redefine the term ‘lawfully present.’”
Kansas Attorney General Kris Kobach (R) was among those who took a victory lap on Monday after the ruling was announced.
Kobach stated, “This decision is a big win for the rule of law,” Kobach said. “Congress never intended that illegal aliens should receive Obamacare benefits. Indeed, two laws prohibit them from receiving such benefits. The Biden administration tried to break those laws. But we fought back and defeated the Biden Justice Department.”
The Biden administration has not yet announced how it will respond to the ruling, and no comment was made on the case, as it is still active litigation.
