Justice Kavanaugh Shuts Down Insurrection Narrative

The entire key to removing Donald Trump from the ballot via Section III of the 14th Amendment is showing that Trump took part in an insurrection.

Now, there are plenty of people who would say what happened on January 6 was embarrassing, a riot, and horrible for the country, but it did not go so far as to be an insurrection.

To that point, Donald Trump has never been charged with taking part in or supporting an insurrection or any derivative of an insurrection, such as sedition. Justice Kavanaugh brought up that exact point during oral arguments on the Trump-Colorado ballot case that is now before the Supreme Court.

Never Been Charged

No, Section III of the 14th Amendment does not call for an indictment or verdict, but there are federal statutes in place that would require that to happen before the amendment can be activated.

Justice Kavanaugh leaned into those statutes while oral arguments were taking place…

This is the obstacle that Democrats must overcome if they expect Trump to be removed from the ballot, and my feelings as to which way the court will fall were more or less summed up by Kavanaugh.

It cannot be left up to a single state or person to decide this matter.

Trump must be indicted and convicted, proven to have participated in such an act on a federal level for this amendment to be activated.

The truly damaging aspect of this case for Democrats is that it appears this is going to be a unanimous decision by the Supreme Court.

As I have maintained all along, this is the only way the decision will not be questioned by the White House or media. If the vote came down along ideological lines, the media would have blown up.

Now, they would have to attack their own justices, including a Biden justice, and I don’t see that happening.
