Justice Ketanji Brown Jackson is hitting the ground running.
An attorney for a group of students seeking to end affirmative action got an earful from the new justice.
In addition to challenging the position itself, Jackson even questioned if the group had legal "standing" to file the suit.
Activist on the Bench
We warned about this when Jackson was nominated for the court.
She has proven to be far left in her limited time on the bench prior to being nominated.
Jackson challenged Students for Fair Admissions (SFFA) attorney Patrick Strawbridge, "Why is it that race is doing anything different to your members' ability to compete in this environment?
"It's in the context of all of the other factors…the admissions office is looking at.
"You haven't demonstrated or shown one situation in which all they look at is race.
"They're looking at the full person."
The fact that Jackson even looks at this in that manner is fairly scary.
Race should not even be a qualifier, period, but it is, but it is not going to be the only qualifier.
Affirmative action is based on people of similar qualifications with the nod going to the minority, even in cases where they are not quite as qualified as the other candidate.
So while it may not be the "only" qualifier, it is heavily weighted to influence the decision, which was Strawbridge's retort.
He stated, "It makes no sense in a zero-sum game.
"If we are going to consider race, and we argue that a racial classification – which is highly disfavored at law because of its necessarily invidious nature – is going to be used, it clearly must be doing some work."
He continued that schools are "making distinctions upon who it will admit at least in part on the race of the applicant.
"Some races get a benefit. Some races do not get a benefit."
Jackson seemed to challenge Strawbridge on every front, so we know where her vote is going.
More concerning, however, is the fact that she is showing she is more activist than justice, and that is absolutely terrifying.
