Judge in Hunter Biden tax case accuses president of trying to 'rewrite history'

The judge who presided over the California tax fraud case that resulted in a guilty verdict against Hunter Biden is calling out Joe Biden for his blatant attempt to "rewrite history" by pardoning Hunter Biden.

Biden "mischaracterized and minimized" the seriousness of Hunter Biden's crimes when the pardon was announced, according to U.S. District Judge Mark C. Scarsi.

"The Constitution provides the President with broad authority to grant reprieves and pardons for offenses against the United States, but nowhere does the Constitution give the President the authority to rewrite history," Scarsi wrote on Dec. 3.

Hunter Biden's attorney asked the judge to dismiss the indictment almost immediately after Joe Biden decided to pardon his son. However, the lawyer did not initially submit a formal copy of the pardon.

Instead, the judge received a link to Joe Biden's statement that Hunter Biden had been "selectively, and unfairly, prosecuted" and that the result of the trial was a "miscarriage of justice."

Scarsi said that Joe Biden's "representation" of Hunter Biden's crimes "stand in tension with the case record." That's Scarsi's fancy way of saying that Hunter Biden's crimes were a lot more serious than Joe Biden is portraying them.

"For example, the President asserts that Mr. Biden 'was treated differently' from others 'who were late paying their taxes because of serious addictions,' implying that Mr. Biden was among those individuals who untimely paid taxes due to addiction. But he is not," the judge said.

Hunter Biden pleaded guilty in this case and even admitted to some of the crimes with which he was charged.

"Upon pleading guilty to the charges in this case, Mr. Biden admitted that he engaged in tax evasion after this period of addiction by wrongfully deducting as business expenses items he knew were personal expenses, including luxury clothing, escort services, and his daughter’s law school tuition. And Mr. Biden admitted that he 'had sufficient funds available to him to pay some or all of his outstanding taxes when they were due,' but that he did not make payments toward his tax liabilities even 'well after he had regained his sobriety,' instead electing to 'spen[d] large sums to maintain his lifestyle' in 2020," Scarsi wrote.

The California case is not the only one being covered by the pardon.

Joe Biden also pardoned his son from a gun-related case in Delaware.

In that case, Hunter Biden was convicted earlier this year but is still awaiting sentencing.
