Judge Denies White House Effort to Block Daily Wire Censorship Suit

The Biden administration continues to be thwarted by Trump-appointed judges.

The latest is a ruling regarding a censorship lawsuit that the Daily Wire brought against Biden’s State Department.

The Daily Wire had been joined in its suit by The Federalist and Texas.

The suit names Secretary of State Antony Blinken and five other members of the Biden administration.

The suit claims that the State Department and its officials have been engaging with and promoting censorship technology that would eventually bankrupt media outlets simply because the opinions expressed are not in line with the administration's.

The suit claims the scheme is “one of the most audacious, manipulative, secretive, and gravest abuses of power and infringements of First Amendment rights by the federal government in American history.”

The State Department filed several motions in response to the suit. The first was to block the suit, with the second being to change the venue from Texas, where the State Department knows it will have a problem, to a more friendly venue in DC.

U.S. District Judge Jeremy D. Kernodle denied both motions.

In his ruling, Judge Kernodle stated that the plaintiffs “have satisfied their burden to demonstrate standing at this stage in the case,” so the case can move forward.

Regarding the change of venue, Kernodle ruled that the “venue is proper in the Eastern District of Texas.”

The New Civil Liberties Alliance’s Mark Chenoweth, who has stepped up to represent the plaintiffs, stated, “The federal government cannot do indirectly what the First Amendment forbids it from doing directly.”

Texas Attorney General Ken Paxton added, “The State Department’s mission to obliterate the First Amendment is completely un-American.

“This agency will not get away with their illegal campaign to silence citizens and publications they disagree with.”

I can tell you firsthand that limited reach and shadow-banning conservative media is a real thing, as my accounts have been obliterated on these fronts over the last few years, and I call out both sides when I believe they are in the wrong.

I cannot imagine what is happening to personalities that are hardcore MAGA or far-right wingers.
