Judge Chutkan Orders Trump Evidence Can Be Released Before Election
Donald Trump almost got out of this election season virtually unscathed by the worst of the indictments against him.
The Georgia election interference case is tied up, the classified documents case was dismissed, at least for now (I believe that ruling will be overturned on appeal), the Alvin Bragg case sentencing has been delayed until after the election, and Judge Chutkan just set a schedule for the January 6 obstruction case that means the trial will not take place until well after the election.
Chutkan did leave one little landmine, however.
The Evidence
Chutkan set September 26 as a filing deadline for evidence, which means that anytime after that, she can decide to release evidence that Smith has against Trump in the case.
Now, some of that would likely be redacted, but if that comes out in late September or early October, that is all the media will be talking about.
Chutkan could care less, however, even stating that the electoral schedule is none of her concern.
All she is interested in is moving this case forward.
Donald Trump’s attorneys also tried to make the argument that the case should be dropped due to presidential immunity, but Chutkan literally laughed at them.
Perhaps they did not read the indictment, but Smith went out of his way to make it is clear to the court that the charges were against Donald Trump the presidential candidate, removing previous references to Trump as president.
This was done purposely because the immunity only holds to official acts of the president, and the rally was not part of Trump’s presidential duties, so it will not qualify for immunity.
So, now we all sit on pins and needles for the next month to see if what Chutkan will do once Smith submits all his evidence.
For that reason, Trump really needs to knock it out of the park during next week’s debate. He will need a nice cushion if Chutkan decides to drop a last-second bombshell on Trump.
