Judge Chutkan denies motion to block Musk, DOGE

One of the toughest judges in terms of January 6 prosecutions was Judge Chutkan, who had been chomping at the bit to get Donald Trump in her courtroom, having sent dozens, if not hundreds, of January 6 defendants to prison.

It stood to reason that when it came time for her to rule against the Trump administration, she would rubber-stamp requests from Democrats and liberal activist organizations.

When she recently denied a challenge to DOGE requests, I can confidently say I was not alone in being shocked at the ruling.

The problem for Democrats is that they are acting as though an advisory board like DOGE is something that has never been done before.

And when you hear Democrats talk about DOGE in the media, they make it sound as though every decision-maker in history has been an elected official, not to mention the fact it is not Elon Musk making the final call... it is Donald Trump.

Even so, with today's tainted judiciary, it was a surprise to see Judge Chutkan initially deny the challenge to DOGE.

When plaintiffs tried to argue that DOGE is doing irreparable harm to this country, Judge Chutkan was not buying it.

She ruled, "Plaintiffs ask the court to take judicial notice of widespread media reports that DOGE has taken or will soon take certain actions, such as mass terminations."

She continued that the reports cannot substitute for "specific facts in an affidavit or a verified complaint" that "clearly show that immediate and irreparable injury, loss, or damage will result."

So far, 14 states, all blue of course, have joined the effort to block DOGE.

Now, this is only a temporary win because the constitutionality of the Musk appointment seemed to hit a soft spot with Chutkan, but again, every president has advisers who serve in similar roles as Musk.

To that point, Chutkan wrote, "Musk has rapidly taken steps to fundamentally reshape the Executive Branch.

"Even Defendants concede there is no apparent 'source of legal authority granting [DOGE] the power' to take some of the actions challenged here."

But again, DOGE is not making the final call; the president is, so that argument should be invalid.
