Judge blocks deportation of pro-Palestine protester at Columbia
Once again, a judge has cut the Trump administration's legs from under it.
Columbia agitator Mahmoud Khalil was recently detained, reportedly to be deported after his “illegal” protest activities at Columbia University.
However, a lower-court judge just halted the deportation, as I had predicted when we reported his arrest.
Not So Fast
So, I know everyone is probably livid about this, but don’t get too upset just yet.
According to our immigration laws, only an immigration judge can revoke a green card, which Khalil had.
From the reports I have read, he is also married to an American citizen who is eight months pregnant.
Technically, the ruling by the judge is the right ruling, as the feds cannot simply snatch someone up who has a green card and deport them without proving that individual has committed a violent or felony crime.
Now, DHS and Secretary Rubio have claimed they have evidence that Khalil is aligned with Hamas, so all they have to do is provide that evidence and per our immigration laws, Khalil would be deported.
For the immediate future, however, he is safe.
Khalil’s attorney, Amy Greer, stated, “The remarks by government officials, including the President, on social media only confirm the purpose – and illegality – of Mahmoud's detention.
“He was chosen as an example to stifle entirely lawful dissent in violation of the First Amendment. While tomorrow or thereafter the government may cite the law or process, that toothpaste is out of the tube and irreversibly so.
“The government’s objective is as transparent as it is unlawful, and our role as Mahmoud’s lawyers is to ensure it does not prevail."
His wife added, "Mahmoud is my rock, he is my home, and he is my happy place…
"For everyone reading this, I urge you to see Mahmoud through my eyes as a loving husband and the future father to our baby.
“I need your help to bring Mahmoud home, so he is here beside me, holding my hand in the delivery room as we welcome our first child into this world. Please release Mahmoud Now."
So, after the statements by government officials, they need to show their evidence that Khalil is aligned with Hamas or that he was among those who threatened Jewish students on campus.
If they cannot do that, they are going to have a huge chunk of egg on their face and give the Democrats serious ammunition to use against the GOP in the upcoming election.
On the other hand, if they can produce that evidence, the Dems who are sticking up for Khalil are going to have some serious explaining to do.
