Judge Believes Giuliani Case Will Be Dismissed

The man who was once considered America’s Mayor has fallen on very hard times.

Trump ally Rudy Giuliani has been rocked by legal settlements, the most notable being a $148 million defamation suit that he faced regarding claims he made against two Georgia election workers.

The judge in the case is now considering dismissing the bankruptcy case, and while it will allow Giuliani to proceed with appeals, it will block protections that bankruptcy would have afforded him, including Giuliani’s preference of liquidation.

More Tough Times for Giuliani

This ruling gets really complicated when you look at the case from Giuliani’s perspective.

Creditors are fighting to get every penny they can from Giuliani, and that would have been limited had the bankruptcy gone through.

His creditors have been claiming from the outset that Giuliani was flouting bankruptcy laws and possibly even hiding assets to push this forward.

The dismissal of the case will significantly change Giuliani’s approach, as his creditors will now be able to pursue other means of pursuing his assets to recover their funds.

For instance, they could sue to have some of Giuliani’s assets seized to pay off his debts.

U.S. Bankruptcy Judge Sean Lane is clearly leaning in this direction, stating, “I’m leaning toward dismissal, frankly, because I’m concerned that the past is prologue.”

Attorney for the Georgia election workers, Rachel Strickland, stated, “The question here is always going to be the cat-and-mouse game of what dollar can be funneled outside of the estate.

“Out in the real world, outside of bankruptcy, all dollars are fair game for everyone and Mr. Giuliani has to continue to live and do whatever it is he is able to do with his name, likeness, and commentary in order to make a living.”

In a worst-case scenario, Giuliani will literally be left penniless.

Between his business and personal assets, Giuliani has only about $325,000 in cash, and nine-figure debt looms.

He would have been able to save some of his assets, but without bankruptcy protections, he is likely to lose everything he has to satisfy these judgments.
