Jack Smith Withdraws from Trump’s Classified Documents Case
If the classified documents case initially filed by Special Counsel Jack Smith continues at some point, it will have to happen without him.
According to reports, Smith transferred all relative documents over to federal prosecutors in the Southern District of Florida.
Smith formally dropped the charges in his cases against Trump, but this was done without prejudice, so the charges can be brought again in the future if another prosecutor decides to represent the case.
Time to Go
This is Jack Smtih removing himself from all obligations so he can resign as Special Counsel.
In the classified documents case, Trump had a friendly judge that he appointed, Judge Aileen Cannon.
Cannon eventually bought into the idea that Smith was illegally appointed, even though precedent on this was in place for decades after being heavily litigated in the 1970s.
If her ruling had been challenged and failed, it would have meant that virtually every Special Counsel dating back to the Nixon era would have been nullified.
After Donald Trump won the election, Smith dropped his appeal, allowing Cannon’s ruling to stand, at least for now.
Smith also dropped the charges in the J6 case that was before Judge Chutkan, who was anything but Trump-friendly.
But again, the case was dismissed without prejudice.
Smith's purposeful move was to ensure that if a Democrat wins the White House in 2028, the new AG can revive the charges and refile.
There are a lot of people in the MAGA world who want charges brought against Jack Smith, but I just don’t see it happening.
The only exception would be if they find some collusion between Smith, Letitia James, the New York Attorney General, Alvin Bragg, the Manhattan DA, and Fani Willis, the Fulton County DA.
My preference on this would be that the GOP just drops it and goes to work for the American people, but they all want to win Trump’s favor so badly, my guess is that they are going to burn millions in our tax dollars chasing their tails to get headlines on this subject.
If I sound bitter, I am because Congress wasted millions going after Joe Biden, and we still don’t have an indictment even though we all know the man is corrupt.
Forget investigations and do what you are actually being paid for… legislating.
