Incoming Trump admin is expected to make big Supreme Court move: report
The incoming administration of President-Elect Donald Trump is expected to make some consequential moves at the U.S. Supreme Court.
According to a new report from the Washington Examiner, Americans ought to expect the Trump Department of Justice (DOJ) to reverse the positions taken by the Biden DOJ in several ongoing Supreme Court cases.
Changes of this nature are not unusual when a new administration takes over, particularly when the administrations are of different political parties, as is the case with Biden and Trump.
This time around, however, the changes are going to be a bit more noticeable given some of the extreme policies and positions taken by the Biden administration.
Here is what to expect:
The Examiner reports:
President-elect Donald Trump‘s incoming Justice Department is likely to reverse the Biden administration‘s positions in several key Supreme Court cases, from transgender issues and firearm regulations to abortion access, flavored vaping products, and immigration policies.
Such issues have yet to be decided by the U.S. Supreme Court, although many of them are before the court. The Trump DOJ, however, will be taking a completely different position from the position that has been espoused by the Biden DOJ.
For one example, the Examiner calls attention to United States v. Skrmetti, where the issue is "Whether Tennessee’s ban on gender-affirming care for minors violates the equal protection clause."
Per the outlet:
The Biden administration has argued that Tennessee’s law discriminates against transgender youth and violates constitutional protections. The Supreme Court heard oral arguments in the case on Dec. 4, 2024, just weeks before the Trump DOJ is expected to reverse the government’s position, aligning with Tennessee and arguing the law is a valid exercise of state authority.
The outlet goes on to provide other examples.
Looking forward
The big question is how the Supreme Court will handle this situation, particularly in a case such as Skrmetti, where the justices already heard arguments - including from the DOJ - but now the Trump DOJ is going to take a completely different position.
We're just going to have to see how this plays out.
In the meantime, the Supreme Court seems to be making its own preparations ahead of the change in presidential administration.
Just recently, Chief Supreme Court Justice John Roberts put out a statement arguing that the United States must maintain "judicial independence."
According to Fox News, Roberts, in part, wrote:
Within the past few years, however, elected officials from across the political spectrum have raised the specter of open disregard for federal court rulings. These dangerous suggestions, however sporadic, must be soundly rejected. Judicial independence is worth preserving.
