Hunter Biden's lawyers use Clarence Thomas argument in dismissal attempt
Hunter Biden's lawyers are desperate to try anything they can to keep their privileged client from receiving any consequences for his multiple felony convictions, and now they're trying something VERY unconventional.
Biden's team is clinging onto an opinion recently penned by Clarence Thomas, despite the rest of liberal America rejecting the Supreme Court justice's statement.
Recently, Thomas issued an concurring opinion that potentially got in the ear of Judge Aileen Cannon, the person who was overseeing Donald Trump's Mar-a-Lago case down south in Florida.
In early July, the U.S. Supreme Court decided that "former presidents have broad immunity from criminal prosecution," with Clarence Thomas adding a little extra flourish to his version of the decision.
Thomas not only agreed that Donald Trump should have some immunity for conduct while in office, but he also brought up the contention that Jack Smith may have been illegally appointed to prosecute Trump in the first place.
As a result of the facts in front of her and of Justice Thomas' opinion, Cannon decided to throw out Smith's documents case against Donald Trump.
Now, despite Hunter Biden having already been convicted in his gun case, his lawyers are trying to use Thomas' decision as a reason to reject the case altogether.
Sure, Thomas' opinion was written in context of the fact that the subject of Smith's prosecution was America's former president, but that didn't let Hunter Biden's lawyers stop them from claiming their client should face no penalties.
"Guided by Justice Thomas' opinion, Judge Cannon dismissed an indictment against President Trump earlier this week because the Special Counsel was unconstitutionally appointed," Abbe Lowell, an attorney for Hunter Biden wrote.
Lowell continued, "Based on these new legal developments, Mr. Biden moves to dismiss the indictment brought against him because the Special Counsel who initiated this prosecution was appointed in violation of the Appointments Clause as well."
Hunter Biden is currently in a lot of legal trouble, and it's fair to say that his life would pretty much be over if his father wasn't the president.
The president's son has already been convicted on three felony counts in Delaware, and he's facing federal tax crime charges soon in a Los Angeles federal court.
Liberals didn't like Thomas' decision when it resulted in the dismissal of Trump's case, but suddenly Hunter's team is all about it.
Biden is seeking to have both cases dismissed using the above logic.
Let's pray that he is unable to do so.
