A reporter for the conspiracy site InfoWars is headed to jail.
Owen Shroyer, who was not even inside the Capitol that day, has been sentenced to 60 days in prison, reported NBC News.
He avoided a much stiffer sentence that prosecutors had recommended.
Going to Jail
Shroyer was doomed in this case from the start, with the case going before Judge Timothy Kelly, a Donald Trump appointee.
Kelly has handed down some pretty stiff sentences, including the longest sentence to date, which was given to Proud Boys leader Enrique Tarrio.
Tarrio, who was not at the Capitol that day, having been taken into custody two days prior due to another investigation, was given 22 years.
When Kelly sentenced Tarrio, he did so because prosecutors made the case that while he was not present, he played a significant role in the planning.
Shroyer pleaded with Kelly, "I was not a part of any larger plan for illegal activity or violence that day."
But prosecutors argued, “Shroyer helped create January 6.
"The government respectfully requests that this Court sentence him to 120 days of incarceration, 12 months of supervised release, 60 hours of community service, and $500 in restitution.
"In the months prior to January 6, Shroyer spread election disinformation paired with violent rhetoric to hundreds of thousands, if not millions, of viewers."
Judge Kelly split the difference, giving Shroyer 60 days.
Shroyer's attorneys stated, "Mr. Shroyer, and every person capable of speaking in the United States, has a right to utter the speech Mr. Shroyer used. That the Government would suggest otherwise is a frightening commentary on our times.
"The Government’s sentencing memorandum is a shocking effort to criminalize dissent and warrants a stiff rebuke from this Court. Mr. Shroyer has every right to believe, and to assert to this very day, that the 2020 election was stolen."
With the sentences I am seeing handed down, I cannot imagine what Trump will be facing if he is found guilty.
