Fani Willis Asks Court to Reinstate Trump Election Charges
Since Fulton County DA Fani Willis filed her charges against Trump, six of them have been dismissed by Judge Scott McAfee.
As I have noted in previous reports, McAfee, by far, has been the fairest of all judges in the these cases.
Now Willis is hoping to have his decision reversed, filing an appeal in the hopes of having the dismissed charges reinstated.
Reinstating the Charges
Willis has been dealt setback after setback in this case, and she is currently awaiting a hearing to have her removed from the case altogether.
When McAfee initially dismissed some of these charges, he did so because he found that the case was hastily put together and there was not enough evidence to support the charges.
At the time, he wrote, "As written, these six counts contain all the essential elements of the crimes but fail to allege sufficient detail regarding the nature of their commission, i.e., the underlying felony solicited.”
On Tuesday, Willis submitted a filing to have those charges reinstated.
In her filing, she stated, “The indictment included an abundance of context and factual allegations about the solicitations at issue, including when the requests were made, to whom the requests were made, and the manner in which the requests were made.”
Note that she did not add any evidence, so the appeals court will have to decide if McAfee was being particular in the case or if Willis did fall short in presenting the charges.
Again, McAffee has been stellar throughout the initial proceedings, and we have no reason to challenge his ability to make a fair ruling at this point.
Having said that, these types of decisions generally fall in the ideology of the court, and if there are more liberals on that bench, I would suspect the charges would be reinstated against Trump.
Trump has pleaded “not guilt” to all charges, and unless Trump wins the election, he would be expected to be in court for this case sometime early next year.
