On Thursday, the Supreme Court initiated a decision that could lead to yet another flood of migrants into this country that will leave conservatives talking to themselves.
The court issued a unanimous decision in favor of Leon Santos-Zacaria," reports Forbes.
Leon is a transgender, who now goes by the name Estrella.
Leon claims he was raped and was receiving death threats when he revealed he was transgender and for that reason, is requesting asylum rather than being deported back to Guatemala.
Shocking Decision
A lower court had denied the asylum claim because Santos-Zacaria had not followed the proper processes to prove that Leon would be in danger if he returned to his native country.
The court stated that Santos-Zacaria did not have to exhaust all remedies available because of being in danger due to "race, religion, nationality, membership in a particular social group or political opinion."
An immigration judge had initially declined the case. The judge stated that Santos-Zacaria's claims were credible, but the since Santos-Zacaria "did not suffer past persecution, and thus was not entitled to a presumption of future persecution," reports Fox News.
The Board of Immigration Appeal (BIA) also declined to rule in favor of Santos-Zacaria because he "had not shown she would be persecuted in the future."
When an appeal was filed with the 5th Circuit Court of Appeals, it was declined because Santos-Zacaria did not exhaust all remedies with the BIA.
Even Biden's DOJ sided against the claim, stating that Santos-Zararia" 'agreed that there was probably a place where she could safely relocate within Guatemala,' a concession that was sufficient to rebut the presumption that petitioner's life or freedom would be threatened if she returned there."
Even with all of that, the court issued a unanimous ruling that Santos-Zararia can stay, now setting a precedent that if you are a transgender in another country and want to live in the United States, all you have to say is that you believe you will be in danger after coming out as transgender.
