Court Strikes Down Biden’s Title IX Overhaul

The Biden administration’s fight regarding its overhaul of Title IX for transgender rights is now about over.  

The administration lost another case regarding the new Title IX rules that Biden had submitted.  

The key aspect of the rules change was to change the “sex” to “gender identities,” which just did not fly with the court.  

Gender Identities 

As I have stated in other reports, the fight for conservatives on this front is to protect children from aggressive transition treatments as well as the safety and integrity of women’s sports.  

Kentucky U.S. District Court Chief Judge Danny C. Reeves, an appointee of President George W. Bush, believed the new rules under the Biden administration were government overreach and would have opened Pandora’s box, so to speak.  

In his ruling, Reeves stated, “It is abundantly clear that discrimination on the basis of sex means discrimination on the basis of being a male or female. 

“Expanding the meaning of ‘on the basis of sex’ to include ‘gender identity’ turns Title IX on its head. … The entire point of Title IX is to prevent discrimination based on sex — throwing gender identity into the mix eviscerates the statute and renders it largely meaningless.” 

Reeves later added, “The plaintiffs reasonably fear that teachers’ (and others’) speech concerning gender issues or their failure to use gender-identity-based pronouns would constitute harassment under the Final Rule. 

“Put simply, the First Amendment does not permit the government to chill speech or compel affirmance of a belief with which the speaker disagrees in this manner.” 

Thankfully, this was struck down for now, but if Democrats get back in office, this will be pursued, and I would warn conservatives that these rule changes could hold unless the GOP can drop legislation while Trump is in office to prevent it.  

I say this because it was Trump-appointed Justice Gorsuch, who, in Bostock v. Clayton County, allowed “gender identity” to be substituted for sex.  

We know the three liberal justices will side with the “gender identity” claim, so if one more justice walks across the aisle, Dems could beat us on this particular issue.
