On Friday, Joe Biden took a beating at a federal appeals court.
The Eight Circuit Court of Appeals blocked the administration from forcing Catholic healthcare institutions from performing transgender medical services that would violate their religious "conscience."
The case, Sisters of Mercy v. Becerra, has been dancing around in the courts for some time and will be a landmark case for this administration one way or the other.
This administration is dead set on getting doctors to perform surgeries they do not want to perform.
This entire argument is something that has baffled me for some time, as I simply do not understand why anyone would want a doctor to perform a procedure on them against their will.
This particular rule extends back to the Obama administration.
In 2016, the Department of Health and Human Services implemented the prohibition of discrimination under Section 1557 of the Affordable Care Act.
This rule required all institutions receiving funds from HHS to provide care for individuals based on their gender identity.
If a doctor or institution was caught violating the rule, it could face severe fines and penalties.
Catholic healthcare institutions sued, stating that the new rule "forces doctors to perform controversial and sometimes harmful medical procedures" and violates their religious conscience.
On January 21, 2021, U.S. District Court Judge Peter D. Welte ruled against the administration, and the Biden administration appealed the case.
Once again, on the 8th Circuit, Joe Biden has been defeated.
From here, the administration will have to go to the Supreme Court, where I see it meeting the same fate.
Luke Goodrich, vice president and senior counsel at the Becket Fund for Religious Liberty, stated, "The federal government has no business forcing doctors to violate their consciences or perform controversial procedures that could permanently harm their patients."
I agree with that argument completely.
We would expect the administration to announce its next move very soon.
