Colorado Supreme Court Dismisses Case Against Baker
If you can believe it, a court in a blue state actually got something right.
Masterpiece Cakeshop proprietor Jack Phillips no longer has to worry about getting sued for not making cakes he doesn’t want to make.
The state Supreme Court in Colorado tossed a suit against him for refusing to make a cake for a transgender who was celebrating a transition.

For Phillips, he does not believe in gay marriage and he does not believe in celebrating transitioning from a man to a woman.
When Autumn Scardina came into his shop, Scardina wanted to order a cake to celebrate the transition, and Phillips refused Scardina service.
With the state Supreme Court tossing the case, Attorney Jake Warner finally celebrated after the ruling.
He stated, “Enough is enough. Jack has been dragged through courts for over a decade. It’s time to leave him alone.
“Because that cake admittedly expresses a message, and because Jack cannot express that message for anyone, the government cannot punish Jack for declining to express it.”
Scardina’s lawyer John McHugh was not so enthusiastic, claiming that the justices, all Democrats, “decided to avoid the merits of this issue by inventing an argument no party raised.”
The court had ruled, “Scardina improperly filed her claim anew in the district court.
“We express no view on the merits of these claims.”
We have seen the courts take this approach before when they don’t want to touch a hot potato, and I am guessing the court did not want to touch this one so close to the election.
Courts have done the same thing to Trump in dozens of lawsuits regarding the election, stating that Trump did not have standing.
Technicality or not, I am glad the case is over and would simply recommend that Scardina go find another bakery. I am sure there are plenty of them that would love to make that cake.
