Biden Administration Delays Hearing on Texas Border Buoys
It would appear that the Biden administration is worried about the optics of a case it has against Texas before the election.
So, the Department of Justice just filed a motion, which was unopposed by Texas, to have the trial regarding the lawsuit over the placement of buoys at the border pushed back 60 days.
This means the trial will now take place after the election is over.
Odd Move
For Texas, this makes sense, as the buoys will be permitted to stay in place until the outcome of the hearing.
Texas is actually expected to win this hearing, but what surprises me about this move is that the Biden administration does not want to press this issue to help Kamala in the presidential election.
The buoys were a major point of contention when they were put up, especially after it was revealed that Governor Abbott had placed what appeared to be saw blades in between the buoys to prevent migrants from climbing between them to get over the border.
The Biden administration justified asking for the delay, claiming it was going to use the additional time to “consider appropriate next steps in the district court proceedings in light of the opinion (including necessary consultation with client agencies), and thereafter advise Defendants and the Court on how the United States proposes to proceed.”
The DOJ has asked that the trial be by October 7, “or the next available date and time thereafter,” so to me, this is clearly something that was done to avoid the trial happening during the election.
The only reason I can think of as to why this would be taking place is that the Dems are terrified of shedding more light on the border situation, especially since it will have to defend the awful record of Harris and Walz.
The case will be tried in the Western District of Texas before Judge David Ezra.
Ezra was originally nominated to the bench by Ronald Reagan, with his current appointment being a designation by Supreme Court Chief Justice John Roberts.
