AZ SCOTUS Blocks Abortion Ban from Taking Effect

The Arizona Supreme Court may have just done Donald Trump and the GOP a huge favor heading into this election.

The court granted a stay that will continue to block the 1864 abortion ban from taking effect.

With this law being targeted by Democrats, this stay just might save the state and turn it back red come November.

The stay was requested by Arizona Attorney General Kris Mayes.

Mays had requested a 90-day stay on the law from taking effect, but due to another stay, the law will actually be blocked from going into effect until late September.

Mayes has asked for the additional time to prepare an appeal for the Supreme Court to fight the ban.

The original law was never repealed after Roe v. Wade went into effect, so after that ruling was overturned by the Supreme Court in the Dobbs decision, the Arizona Supreme Court ruled that the law could now be enforced.

Governor Katie Hobbs then signed a repeal of the law, but that would not go into effect until 90 days after the state legislature adjourned for the year.

If the repeal eventually goes into effect, former Governor Doug Ducey’s 15-week ban will take precedence.

On Monday, Mayes added context to his case, stating, “I continue to believe this case was wrongly decided, and there are issues that merit additional judicial review.

“I will do everything I can to ensure that doctors can provide medical care for their patients according to their best judgment, not the beliefs of the men elected to the territorial legislature 160 years ago.”

Abortion has cost the GOP over the last few elections, and if the GOP does find a way to get this issue settled, it will continue to cost them moving forward.

It has gotten to the point that one-time hardliners on abortion are now realizing that if a federal law is not in place, the GOP is doomed to struggle in every election because they know that Dems will continue to make this a top-of-mind campaign issue until the end of time.

So, believe it or not, Democrat maneuvering here has probably helped the GOP.
