Appellate Court Holding Back Decision on J6 Case Post SCOTUS Ruling

RealClearInvestigations journalist Julie Kelly just blew up social media with a report.

She was highlighting a decision by the DC Appelate Court to hold off on its ruling for an exceptionally long time in the Couy Griffin conviction.

The reason seems to be that the court, which has a Clinton, Obama, and Trump judge, is worried about how the recent Supreme Court decision in the Fischer case will impact the appeal.

Typically speaking, a ruling is passed down inside of six months after oral arguments are heard, and that would be an exceptionally long time.

In most cases, that window is about three to five months.

The appeal in the Griffin case was heard on December 4, 2023. The case was originally heard in March 2022.

Griffin was convicted of the misdemeanor charge of entering restricted grounds/building.

This is important because the charge was involved in the obstruction definition that SCOTUS shredded in the Fischer case.

The SCOTUS ruling heavily impacted many of the January 6 riot cases because the charge faced by Griffin was a charge found in just about every case.

Kelly posted, “Dem-heavy DC appellate court recognized the threat to the J6 prosecution AND narrative if both the most common misdemeanor and most common felony (1512c2) were reversed by higher courts.

“Since SCOTUS granted cert, the court held oral arguments in April and posted its decision on June 28.

“That entire time, the DC appellate court--an Obama appointee is the chief judge--SAT on releasing its order related to Griffin's appeal and continues to do so. Normal time btw oral arguments and decision is 4-5 months.

“Apparently, this is not concerning to the ‘legal experts’ who have accused other courts of slow walking key opinions in other political cases.”

Is the appellate court purposely slow-walking cases to keep J6 defendants in jail for as long as possible, or is there a legit reason for this?

Kelley is calling it a “major scandal,” but to this point, this has not even made the news. I guess we will see if her report lights a match under the appellate court and the media.
