Appeals Court Hands Trump Big Win
Robert F. Kennedy Jr. may be the person on the court documents, but the big winner here is Donald Trump.
Kennedy just won two different appeals cases to have his name removed from the ballot.
In both North Carolina and Michigan, the appeals panels ruled in his favor, so his name will be off the ballot, at least for now.
Big Win
North Carolina, since 1980, has only gone to Democrats one time, that being in 2008 to Barack Obama.
While the margin of victory has not been significant since that race, it has been dominated by Republicans.
Once again, this year's race is tight in North Carolina, with Trump currently holding a 0.5% edge in the average of all polls and a one—to two-point edge in recent polling.
For all intents and purposes, this is now a battleground state, which makes it imperative that we get Kennedy off the ballot if he is not running.
The same is true of Michigan, which Trump won in 2016, but a state that Democrats have taken in all but one election since 1992, most of them fairly close.
I don’t see a path for Harris without the Blue Wall states, so Michigan is atop the wish list this election.
Both Democratic Secretaries of State refused to remove Kennedy from the ballot, and he lost in the lower courts, but his appeals have worked out perfectly thus far.
Both states are just about ready to mail out their absentee ballots, so it was rather urgent for Kennedy to have this addressed.
This may not be the end of this saga, however, as Democrats are expected to take both cases to their respective State Supreme Court.
For now, we can breathe a sigh of relief, but if the cases are lost at the State Supreme Court level, expect Kennedy to file for an emergency appeal with the Supreme Court of the United States, where I would expect him to win his case.
