Judge Gives Thumps Up to Red State Lawsuits Against Abortion Drug

For what seems like years now, several red states that have extreme abortion laws have been trying to block access to the abortion drug, mifepristone, via the mail.

Now, a Texas judge has stated that the lawsuits can move forward, with the decision coming months after the Supreme Court rejected a case on the matter.

Not surprisingly, it was a Trump-appointed judge, U.S. District Judge Matthew Kacsmaryk, who ruled to allow the challenges to move forward.

Last year, the Supreme Court completely rejected the challenges, stating that there was no legal basis for private parties to challenge access to the drug.

The Court ruled that the doctors who had followed the suit did not suffer any harm due to the government regulations on this particular drug.

The new case claims that the FDA’s regulations on the drug have allowed the pills to be distributed within their borders, undermining current abortion laws, as well as putting the health of these women at risk.

The suit is hoping to reign in loosened FDA regulations on the drug that now allow it to be prescribed through the first 10 weeks of pregnancy, as well as it being available to be prescribed by telemedicine doctors and sent via mail.

The Biden administration has been fighting the case, claiming that Kansas, Idaho, and Missouri did not have the right to bring the case to Texas.

This subject came up during Attorney General Pam Bondi’s confirmation hearing, but Bondi did not state if she would defend the FDA’s position, saying that she needed to see the information firsthand before making that call.

I actually love the fact that Bondi has taken this approach, preferring to get through the door to see the actual evidence rather than making a blind commitment without knowing all the facts.
