Bragg Responds to Trump Motion to Dismiss Hush Money Case

Manhattan DA Alvin Bragg has been getting hit by uppercuts this week, and Donald Trump is pouring more fuel on that fire.

Trump’s legal team has made a motion to dismiss the hush money case against Trump, of which Trump continues to await sentencing.

Bragg finally responded to the filing, not giving the response that Trump wanted to hear.

Not Giving In

Bragg agreed to allow Judge Merchan to indefinitely delay Donald Trump’s sentencing in the case, which was supposed to have been conducted this month.

Trump claimed that presidential immunity should have the charges dismissed, but Bragg countered that “president-elect immunity does not exist.”

Bragg stated, “At most, defendant should receive temporary accommodations during his presidency to prevent this criminal case from meaningfully interfering with his official decision-making.”

Bragg wrote that Trump’s request for dismissal goes “well beyond what is necessary to protect the presidency and would subvert the compelling public interest in preserving the jury’s unanimous verdict and upholding the rule of law.”

To be honest, I am not sure Bragg can withstand another bad case after just having lost the Penny prosecution in the Jordan Neely murder case.

While Bragg’s case against Trump is complete and utter garbage, he actually has a point here.

Donald Trump was not president when the alleged crimes were committed and the trial took place when Trump was only a candidate, so there is no presidential immunity.

Even if that were up for debate, Trump would lose that argument because actions taken on behalf of his business would not be covered under presidential immunity.

While many expected Bragg to cave, I just don’t see him giving up this verdict without a fight.

I think he will be more than happy to have this sentence sitting over Trump’s head the entire time he is in office, then resume the sentencing hearing after Trump leaves office.

Honestly, since the other cases were dismissed without prejudice, if Democrats win in 2028, I would not be surprised one bit to see a Democrat-run DOJ refile the cases against Trump and prosecute him to the fullest with no danger of Trump going back into office.

The only way I think these cases are truly over is if the GOP wins again in 2028, getting it to the point that nobody will care about the cases by the time Dems get back in power, if Trump would even be alive by then.
