Smith Drops Second Case Against Donald Trump
In terms of federal cases, Donald Trump is now officially out of the woods.
As we expected, Special Counsel Jack Smith has asked the court to dismiss his appeal in the classified documents ruling by Judge Cannon.
The appellate court granted the request, meaning that Trump’s federal legal problems are now gone... at least for the time being.
Game Over
Judge Cannon, a Trump appointee, had dismissed the case based on the premise that Smith was illegally appointed as the Special Counsel.
Had this appeal played out, I believe the case would have been revived.
Smith appealed the decision immediately after the Cannon ruling was announced, but now he is dropping the case, citing the federal law that a sitting president cannot be tried.
Again, however, the case was not dismissed with prejudice, which means that, technically, the case could be revived once Trump leaves office.
Additionally, we should note that the other defendants in related cases will continue to face charges.
Trump’s valet, Walt Nauta, and Mar-a-Lago property manager Carlos De Oliveira, are still being charged by Smith.
At this point, Trump is only awaiting the sentencing in the business fraud case brought by Manhattan DA Alvin Bragg as well as the election case brought by Fulton County DA Fani Willis.
The Bragg case’s sentencing has been indefinitely delayed by Judge Merchan, but the Willis case is very much in the air based on appeals to have Willis removed from the case.
I suspect all cases will be halted until, at the very least, Trump is out of office, if not completely dropped as a nod to federal laws.
I keep warning everyone, however, that this makes the 2028 election just as important as the 2024 election for Trump.
If Democrats get back in power in 2028, you better believe a Democrat AG will fire up these cases again to go after Trump.
They will continue to come at this man until he is put into his grave.
